Default is a lawyer really neccesary for starting a buisness?

i have a friend who is very interested in buying an existing buisness, she strongly insists on not making any move without without the consulting of a lawyer...is she being too cautious or is this necessary?

If you are buying an existing business then a lawyer would probably be a very good idea. However, if you have a good accountant, then he/she should be able to guide you through the process and tell you what you need to know and do.

You will without any doubt need a lawyer to buy a business.

Like a house the deal has to be closed properly.

There are also hundreds of ways a business can be purchased, an asset purchase, share purchase, good will purchase, etc.. On a simple purchase of business there are well over ten standard documents alone that have to be completed.

I fall on the side of using a lawyer. People have gotten way to fast to sue to not insure that all the proper steps are taken. And even if you hire a lawyer something may still go wrong!

If there is any doubt in your mind you should always have a lawyer and an accountant help you in looking over a perspective business purchase. In this case you always want to look the gift horse in the mouth

The answer is really yes and no depending on the situation. If you are buying a business you know from people you know then I'd say not really but if it is a business from someone you do not know I would say yes. It really is to protect yourself and make sure all the i's are dotted.
